A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from immigration custody, finding his continued detainment lacks lawful basis.
"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been re-detained, again without legal justification," the judge stated in her order.
The situation originates in a erroneous deportation to El Salvador in March, which the government later admitted was an mistake. Following his return to the United States to face alien smuggling charges, he was detained in immigration detention.
In her decision, the court noted that the authorities lacks a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."
